1. Agreement to Terms

By accessing or using Mnemova ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service

Mnemova is a spaced-repetition study platform that allows users to create decks of exercises, study with a scheduling algorithm, and track their learning progress. The Service is available as a web application at https://mnemova.com and as a mobile application.

3. Account Registration & Security

To use most features of the Service you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your password secure and not share your account with others
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

You must be at least 16 years old to create an account. By registering, you confirm that you meet this requirement.

4. Free and Paid Plans

Mnemova offers a free tier and paid subscription plans.

Free Tier

The free tier is supported by advertising. Ads are shown only to free-tier users and guests, and only with your cookie consent. Free features may be limited compared to paid plans.

Paid Subscriptions

Paid plans are billed in advance on a recurring basis (monthly or annually). By subscribing you authorize us to charge your payment method at the start of each billing period. All prices are inclusive of applicable taxes unless stated otherwise.

Paid plans remove ads and unlock additional features. We reserve the right to adjust pricing with reasonable advance notice.

5. Cancellation & Refund Policy

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access to paid features until that date. For full details on cancellation and EU right of withdrawal, see our Cancellation & Refund Policy.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Upload or share content that is unlawful, harmful, or infringes third-party rights
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Scrape, crawl, or extract data from the Service without written permission
• Transmit malware, spam, or any disruptive code
• Impersonate any person or entity

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

7. User Content

You retain ownership of all content you create within Mnemova (decks, exercises, notes, study data). By using the Service you grant Mnemova a limited, non-exclusive, worldwide, royalty-free license to store, sync, and display your content solely to provide the Service to you.

We do not claim ownership of your content and will not sell it to third parties. You are solely responsible for the legality and accuracy of content you create.

8. Intellectual Property

The Service, including its design, code, trademarks, and all non-user content, is the exclusive property of Mnemova and is protected by copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

9. Advertisements

The free tier of Mnemova displays advertisements served by Google AdSense (web) and Google AdMob (mobile). Ads are only displayed after you have given cookie consent. Paid subscribers do not see advertisements.

10. Service Availability & Changes

We aim for high availability but do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue any part of the Service at any time. Where possible, we will provide reasonable advance notice of significant changes.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will meet your requirements or that results obtained will be accurate or reliable.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Mnemova and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or interruption of service, arising out of or related to your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Brandenburg, Germany, unless mandatory consumer protection laws in your country of residence provide otherwise.

If you are a consumer in the EU, you may also benefit from the mandatory provisions of the law of your country of residence.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via email or a prominent notice in the Service at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
